Notice is hereby given that the City Council of the City of Sunset Valley, Texas will hold a Called Meeting on Tuesday, the 3rd day of March 2009 at 7:00 p.m., in the Council Chambers, Municipal Building, 3205 Jones Road, Sunset Valley, Texas, at which time the following items will be discussed, to-wit:

I. Call to order of the City Council.

II. Approval of Revised Minutes for January 27th, February 3rd, and February 10th, 2009.

III. Citizen/Public Communication.

IV. Staff, Committee and Mayor’s Reports on subject matters in written report issued on February 25, 2009.

a. Police Department Report on subject matters in written report issued on February 25, 2009.
b. Public Works Department Report - as issued in written report on February 25, 2009.
c. Administrative Department Report on subject matters in written report issued on February 25, 2009.
d. City Administrator Report on subject matters in written report issued on February 25, 2009.
e. Councilmember Jenkins Report on Planning & Environmental Committee, Arts Commission and Walk for a Day Update. 

V. Council consideration of agenda items for approval on consent.

VI. Consideration and possible approval of the 2008 Racial Profiling Analysis / Citizen Contact Report.  (Mayor Pro Tem Moore / Chief Houston)

VII. Consideration and possible approval of a Temporary Special Use Permit for the Thomas Carnival at Toney Burger Center from March 25th  through April 6th , 2009.  (Mayor Mills / Administration)

VIII. Proclamation issued by the Mayor and the City Council declaring March as “Spring Cleaning Month”.  (Councilmember Jenkins / Public Works)

IX. Proclamation issued by the Mayor and City Council declaring March 14, 2009 as “Fire Ant Day”.  (Councilmember Jenkins / Public Works)

X. Presentation on 2010 Census Partnering Opportunities from Ivonne Espada-Simeon.  (Mayor Mills / Administration)

XI. Consideration and possible approval of  an Ordinance establishing a procedure for making impervious cover determinations of single family residential lots and maintaining records of such determinations; providing for the promulgation of regulations for calculating the amount and percentage of impervious cover located on such lots, and provide for reliance on such a determination in connection with future development applications.  (Mayor Mills / Administration)

XII. Consideration and possible approval of an Ordinance amending Chapter 4 of the City’s Land Development code, providing revised regulations for administrative approvals and variances from watershed protection regulations and restrictions on development in development free zones located on single family residential lots, providing for publication of notice of the Amendment, and providing for severance.

XIII. Presentation and discussion of Trails Master Plan and take action on same.  (Councilmember Jenkins / Administration)

XIV. Consideration and possible approval of the purchase of land located on West Wind Trail and West Gate Blvd. and identify possible funding sources. (Mayor Mills)

XV. Consider authorizing the Legislative Committee to adopt a strategy to oppose legislation that would cause sales tax revenue to be credited to the city of the purchaser’s residence.  (Mayor Mills)

XVI. Consider authorizing the Legislative Committee to support legislation that would exempt teen age employees of Cities from the State nepotism statutes regarding public servants.  (Mayor Mills)

XVII. Discussion of a request by Texas Gas for a rate increase and take action on same.  (Mayor Mills / Administration)

XVIII. Presentation on water line A serving 6401 and 6405 Brodie Lane.(Katy Phillips/Public Works)

XIX. Council to review Sunset Valley Drainage Master Plan Assessment decision matrix with Susan Kelly P.E. LNV Engineering and consider action to be taken.  (Councilmember Smith / Katy Phillips)

XX. Council to review Addendum #1 to Drainage Master Plan Assessment Work Order as submitted by Susan Kelly P.E. LNV Engineering providing for technical hydraulic modeling and time extension for final report and deliverables in an amount not to exceed $42,000.  (Councilmember Smith / Katy Phillips)

XXI. Consider approval of an increase in Promotional Funding for Arts Fest in the amount of $12,573 (Councilmember Jenkins / Arts Commission)


 The City Council will announce that it will go into Executive Session, if necessary,  pursuant to Texas Government Code Section 551.074 to deliberate the purchase,  exchange, lease or value of real property; and to deliberate  any other matter listed  on this agenda for which an exception to open meetings requirements permit  such closed deliberation, as announced at the time of the closed session.

XXIV. Take appropriate action on purchasing the Gault property at 6401 Brodie Lane with  green tax money.
