Notice is hereby given that the City Council of the City of Sunset Valley, Texas will hold a Regular Meeting on Tuesday, the 7th day of  April, 2009 at 7:00 p.m., in the Council Chambers, Municipal Building, 3205 Jones Road, Sunset Valley, Texas, at which time the following items will be discussed, to-wit:

I. Call to order of the City Council.

II. Approval of the minutes from March 3rd and March 10, 2009.

III. Citizen/Public Communication.

IV. Staff, Committee and Mayor’s Reports on subject matters in written report issued on April 1, 2009.

a. Police Department Report on subject matters in written report issued on April 1, 2009.
b. Public Works Department Report, on subject matters in written report on April 1, 2009.
c. Administrative Department Report on subject matters in written report issued on April 1, 2009.
d. City Administrator Report on subject matters in written report issued on April 1, 2009.
e. City Prosecutors Report for January, February, and March 2009. 
f. Mayor’s Report on upcoming Council meetings, seating new Council, information anonymously sent to citizens about other citizens, and preserving decorum at Council meetings

V. Council consideration of agenda items for approval on consent.

VI. Consideration and possible approval of the Financial Statements for January of 09.  (Councilmember Wilson / Finance Committee)

VII. Consideration and discussion of amending Chapter 4 of the City’s Land Development Code, providing revised regulations for administrative approvals and variances from watershed protection regulations and restrictions on development in development free zones located on single family residential lots.  (Mayor Mills / Administration)

VIII. Consideration and possible approval of the revised Trails Master Plan.  (Councilmember Jenkins / Carolyn Meredith)

IX. Discussion of the Street Repair and Replacement Program as submitted by the Public Works Committee and consider action to be taken.  (Councilmember Smith / Public Works)

X. Consideration and possible approval of a recommendation from the Legislative Committee regarding a strategy to pass legislation amending the use of Hotel Occupancy Tax funds in general law cities to include the construction of children’s playgrounds/playscapes in the vicinity of a hotel. (Mayor Mills/Mayor Pro Tem Moore)

XI. Consideration and take appropriate action concerning Legislative Committee recommendation in connection with HB 1508 and HB 595 pertaining to protection of the Edwards Aquifer by preventing treated sewage from being discharged in the recharge zone.  (Mayor Mills / Administration)

XII. Consideration and take appropriate action concerning Legislative Committee recommendation in connection with HB 155 pertaining to access to rivers and river beds.  (Mayor Mills / Administration)

XIII. Consideration and take appropriate action concerning Legislative committee recommendation in connection with HB 4299 pertaining to rainwater harvesting and other water conservation initiatives.    (Mayor Mills / Administration)

XIV. Discussion and direction of Monument Sign on City owned property for Sunset Valley Homestead.    (Mayor Mills / Administration)

XV. Consideration and authorization of a Request for Proposal for a Sunset Valley Ad Campaign.  (Councilmember Kalar / Community & Economic Development Committee)

XVI. Consideration of a report and possible action regarding the use of the HOT Funds.(Mayor Mills / Administration)

XVII. Presentation concerning the Community Rating System to reduce flood insurance premiums in Sunset Valley.  (Mayor Mills / Administration)

XVIII. Consider providing authorization to proceed with an application under the FEMA Community Rating System for a Community rating of 8 to reduce flood insurance premiums

XIX. Public Hearing to consider amending the 08/09 Fiscal Year Budget to provide adjustments to the City Budget.  (Administration)

XX. Consideration and possible approval of an Ordinance amending Ordinance No. 080923-A adopting and approving a budget for the Fiscal Year beginning October 1, 2008 and terminating September 30, 2009, and making transfers and appropriations of funds for projects and accounts affecting administration, Police Department, Public Works, Utility Fund, Water Department, Wastewater, Solid Waste and Hotel Fund. 

XXI. Consideration and possible award of contract for Lovegrass Flashing Yellow Light.  (Councilmember Smith/ Public Works)

XXII. Consideration and possible approval of a Change Order for Joe Bland Construction.  (Councilmember Smith / Public Works)

XXIII. Authorization to proceed to bid on the Brodie Right Turn Lane Project.  (Councilmember Smith / Katy Phillips)


 Council will announce that it will go into Executive Session, if necessary, pursuant to Texas Government Code Section 551.072 to deliberate the purchase, exchange, lease or value of real property; and to deliberate any other matter listed on this agenda for which an exception to open meetings requirements permit such closed deliberation, as announced at the time of the closed session.

 To consult with the City Attorney under the provisions of Section 551.071(2) of the Texas Open Meetings Act on a matter in which the duty of the City Attorney to the Sunset Valley City Council under the Texas Disciplinary Rules of Professional  Conduct of the State of Texas conflicts with provisions of the Texas Open  Meetings   Act.
